Use of this website, icom.museum and all pages in this domain (together, “ICOM website”), constitutes acceptance of the following terms and conditions.
The International Council of Museums (together, “ICOM”) reserves the right to seek all remedies available by law for any violation of these terms of use, including any violation of ICOM’s rights in the ICOM name and emblem and its rights in connection with the information, artwork, text, video, audio, or pictures (together, the “Content”) of ICOM website.

1. ICOM website

a) Use of ICOM website

ICOM website is provided by ICOM for personal use and educational purposes only. Any other use, including reproduction or translation of the Content of ICOM website, or any use other than for personal or educational purposes, requires the express prior written permission of ICOM. Requests for permission should be sent to ICOM using the feedback form, specifying full details of the proposed use. All Content of ICOM website is protected by French law including, as applicable, copyright laws.

The Content of ICOM website is selected on the basis of ICOM’s own criteria and in its own discretion. ICOM reserves the right at any time to change or discontinue any aspect or feature of the ICOM website. ICOM accepts no responsibility or liability for the accuracy or reliability of any element of the Content of ICOM website.

ICOM disclaims any liability or responsibility arising from the use of ICOM website or the Content of ICOM website. ICOM, members of its staff, and its contractors, shall not be liable for any financial or other consequences whatsoever arising from the use of the Content of ICOM website, including the inappropriate, improper, or fraudulent use of such Content.

ICOM disclaims responsibility for any infection by virus or any other contamination or by anything which has destructive properties.

b) Interactive parts of ICOM website

ICOM website may contain bulletin boards, chat rooms, access to mailing lists or other message or communication facilities. Advices, opinions and statements of various information providers that can be found on ICOM website do not necessarily represent ICOM views.

The user agrees, when taking advantage of such facilities, not to do any of the following:
(a) Defame, abuse, harass, stalk, threaten or otherwise violate the rights of others;
(b) Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information;
(c) Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy) unless the user owns or controls the rights thereto or has received all necessary consents;
(d) Upload or attach files that contain viruses, corrupted files, or any other similar software or programmes that may damage the operation of another’s computer;
(e) Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded;
(f) Falsify the origin or source of software or other material contained in a file that is uploaded;
(g) Advertise or offer to sell any goods or services, or conduct or forward surveys, contests, or chain letters; or
(h) Download any file posted by another user that the user knows, or reasonably should know, cannot be legally distributed in such manner.

ICOM reserves the absolute right to delete any material posted to the ICOM website without notice to the user.

ICOM accepts no responsibility or liability in respect of the conduct of any user in connection with such facilities, or for any material submitted by users and carried on ICOM website including, for example, responsibility or liability for the accuracy or reliability of any information, data, opinions, advice or statements made in such material.

c) Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. ICOM website uses cookies to identify visitors, their usage of ICOM website, and their website access preferences. The user who does not wish to have cookies placed on their computers should set their browsers to refuse cookies before using ICOM website, with the drawback that certain features of ICOM website may not function properly without the aid of cookies.

2. Other websites

a) Links on ICOM website

ICOM website may be linked to other websites that are not under ICOM’s control. ICOM does not assume any responsibility or liability in respect of such websites, including, for example, responsibility or liability for the accuracy or reliability of any information, data, opinions, advice or statements made on those websites.

b) Linking to ICOM

ICOM thanks the user for his interest in sharing ICOM’s message with visitors to his website. By adding a link to ICOM website, the user expresses his support for ICOM missions. If the user would like to link to ICOM’s website, he has to contact ICOM for its administrative follow-up. The user may link to the homepage or to a deep content page.

ICOM reserves the right to disallow links at any time. If this is the case, the site maintainers agree to delete the link immediately. ICOM is a non-profit organisation. Therefore, ICOM does not allow a link to ICOM website within commercial web pages. ICOM does not share, exchange or publish links of websites that do not belong to its official partners.

3. Maps and Use of Names

The use of particular designations of countries or territories as well as maps on the website does not imply any judgment by ICOM as to the legal status of such countries or territories, of their authorities and institutions or of the delimitation of their boundaries. ICOM refers to the designation the United Nations recognises for its States members.

The mention of names of specific companies or products (whether or not indicated as registered) does not imply any intention to infringe proprietary rights, nor should it be construed as an endorsement or recommendation on the part of ICOM.

4. Privacy Policy

a) Normal website usage

In general, the user can browse the ICOM website without revealing any personal information. The only information ICOM gathers during general browsing is from standard server logs. These include the user’s IP (Internet Protocol) address, domain name, browser type, operating system, and information such as the website that referred the user to ICOM, the files downloaded, the pages visited, and the dates/times of those visits.

b) Collection of personally identifiable information

If the user requests information, contacts a committee, sends a website page to a friend, provides feedback or applies for a job, he will be asked to provide personal information. This information is collected only with the user’s knowledge and permission and is kept in ICOM databases. ICOM, however, assumes no responsibility for the security of this information. Providing personal information on the ICOM website is optional. If the user chooses not to provide personal information, he can still browse and use the ICOM website, but he will not be able to carry out certain actions.

c) What does ICOM do with the information it collects?

Personal information such as email addresses will not be stored or saved. ICOM does not sell or share any personally identifiable information communicated to ICOM website to any third party. The information will be automatically processed to ensure the receipt of ICOM services and will also be transmitted to third parties (i.e. International or National Committees). In conformity with the French law on Informatics & Civil Liberties (Jan. 6, 1978, rev.) the user has the right of access and to modify the information that concerns him.

ICOM may use the personal information the user provides to:
• Contact him, in particular in response to a query or suggestion. ICOM may also provide the information to ICOM National and International Committees so they can contact the user as well;
• Manage and process a job application;
• “Remember” the user online profile and preferences;

a) The name ICOM – International Council of Museums

The ICOM name and emblem are the exclusive property of ICOM. ICOM benefits from the rights given by the registration of its trademark ICOM – Conseil international des musées – International Council of Museums – Consejo internacional de los museos to the Office of harmonization for the internal market (OHIM). ICOM name and emblem can not be copied or reproduced in any way without the prior written permission of ICOM. Requests for permission should be sent to ICOM using the feedback form.

b) Photos and Publications credits

ICOM offers its information on the Internet essentially for the benefit of individuals interested in its efforts to ensuring the conservation, and protection of cultural goods.

If the user wishes to mirror, reproduce, republish or translate any of the information for wider dissemination, he has to ask a written permission of ICOM using the feedback form with details of such proposed use, including the nature and size of the intended audience. The use of ICOM Internet material for any purpose is prohibited unless prior written permission is obtained.

ICOM reserves all copyrights on its publications, including graphic designs and content as well as on its Web pages, including its Content and graphic designs.
